- Bankruptcy
- Bankruptcy is where a person is insolvent and either petitions for a bankruptcy order to be made against themselves or where their creditor’s petition for a bankruptcy order to be made against them. An insolvency practitioner is appointed as trustee of their estate in bankruptcy. The trustee collects in any monies held by or owed to the bankrupt so as to distribute the same to the bankrupt’s creditors.
- Individual Voluntary Arrangements
- An individual voluntary arrangement (or IVA) is used to create a plan to pay or secure debts owed to creditors. The plan has to be approved by the creditors.
